Ruthe D. Wynne is the Managing Attorney of the Sacramento office of Borton Petrini, LLP. She received her undergraduate degree from California State University, Sacramento in 1997. In 2000, she obtained her J.D. from the University of Pacific, McGeorge School of Law.
Ruthe’s focus practice areas are insurance defense including major casualty, property damage, and premises liability, construction matters, corporate litigation, and transactional matters. She also maintains an active practice of acting as Corporate Counsel or General Counsel to her clients.
A large portion of Ruthe’s work centers on indemnity, insurance clauses, risk transfer, and litigation of claims. She has over 15 years of litigation experience representing clients in various business and civil litigation. She has handled insurance defense claims from initial intake and investigation through trial. In addition, Ruthe has handled numerous complex multi-million dollar property damage claims including construction defect cases, catastrophic injury, product liability, and manufacturing liability.
Ruthe has been actively defending general contractors, subcontractors, material suppliers, building products manufactures, builders and industry leading developers for over 12 years. She has extensive experience negotiating bids, reviewing bid documents, and reviewing, drafting and negotiating public works contracts. She has been the lead counsel, negotiator and/or project manager on a number of complex projects, including but not limited to, new facility construction for a commercial manufacturing plant of windows and acting as lead counsel for the acquisition of a new manufacturing site for a concrete bagging and production facility. She has worked with all levels of procurement contracts, including various aspects of Buy America provisions across industries and FAR requirements for government contracts. Her construction cases include FAR requirements, contract language, workmanship, products liability, ensuing damage claims, contracts, public works, and personal injury litigation occurring during jobsite construction.
Ruthe also has extensive transactional experience. The ability to work on both transactional and litigation cases gives her insight as to the transactional work to better protect corporate clients from risk in their day to day operations. She has drafted, reviewed, and/or negotiated the terms of leases, as well as purchase and sales agreements. These included, but were not limited to, warehouse space, yard space, manufacturing locations and office leases and acquisitions. She has also drafted, reviewed and negotiated terms for tenant improvements, sub leases of portions of owned or leased locations, and evictions of leased properties of her clients’ tenants.
Prior to working at Borton Petrini, Ruthe served as in-house General Counsel to major building material suppliers and manufactures. She was also the supervising attorney for a defense litigation firm’s local office. Her case load centered around the defense of manufacturers, contractors, engineers, and materials supplier’s litigation matters including employment actions, labor union matters, payment disputes, mechanics’ liens, stop notices and construction bonds and public works construction disputes. This included all phases of litigation from pre-litigation, investigation, discovery, motion practice, Mediation, Arbitration and ultimately Trial.
Ruthe is on the Board of Managers for the Facilities Management Company of the international women’s sorority Gamma Phi Beta and a sustaining member of the Sacramento Junior League. In her free time, Ruthe loves traveling with her husband, Kevin, her two daughters, and other family and friends. She also enjoys cooking, entertaining, and watersports.
